API Water 45 Day Performance Guarantee

PRODUCT PERFORMANCE GUARANTEE

At Pure Pools, Inc. dba APi ("APi"), we stand behind the quality and performance of our products. If an EZRES or EZPRO product purchased from an authorized APi seller fails to perform as described in APi's published product literature when used strictly in accordance with APi's written instructions, consumers may request a replacement product or refund of the purchase price, subject to the terms and conditions below.

Eligibility Requirements

To qualify for this guarantee, all of the following conditions must be met:

  1. Authorized Purchase Required: Product must be purchased from an APi authorized seller. Due to concerns about counterfeiting, improper storage, and product tampering, this guarantee does NOT apply to products purchased from unauthorized sellers, online marketplaces, auction sites, or any retailer not listed on APi's authorized seller directory at www.apiwater.com/authorized-sellers.
  2. Residential Use Only: This guarantee applies exclusively to residential swimming pool and spa applications. Commercial pools, water parks, hotels, apartments, condominiums, HOA pools, and any other commercial or multi-family applications are excluded.
  3. Original Purchaser Only: This guarantee is non-transferable and applies only to the original end-user purchaser with valid proof of purchase.
  4. Timely Filing: Claims must be submitted within 45 days of the purchase date and within 30 days of first product use, whichever period ends later. Claims submitted after this period will not be accepted.
  5. Product Quantity Limits: This guarantee is limited to a maximum of $350.00 in purchase value per customer per calendar year.

Required Documentation

All claims MUST include the following documentation. Incomplete claims will be denied:

  • Valid proof of purchase showing purchase date, seller name, and product purchased
  • Clear photographs of the product packaging showing the product lot number
  • Photographs of the product remaining in original container
  • Complete water chemistry test results taken at the time of the alleged product failure, including pH, total alkalinity, calcium hardness, free chlorine, combined chlorine, metals and cyanuric acid
  • Written treatment log documenting: dates of product application, quantities used, water test results, and pool volume
  • Written confirmation from your authorized APi dealer that the product was applied according to APi's instructions (dealer contact information must be provided)



Exclusions - Guarantee Does NOT Apply To:

This guarantee is VOID and does not apply in any of the following circumstances:

  • Dissatisfaction with product color, scent, texture, packaging, or dissolution rate
  • User error, improper application, or failure to follow written instructions
  • Use in water with unbalanced chemistry (pH below 7.2 or above 7.8, alkalinity below 80 or above 120 ppm)
  • Product mixed with incompatible chemicals
  • Product stored improperly, stored in direct sunlight, exposed to excessive heat/cold, or used after expiration date
  • Pool equipment malfunction, poor circulation, inadequate filtration, or structural issues
  • Acts of nature, contamination from environmental sources, or introduction of foreign materials
  • Product purchased in bulk for resale or commercial purposes
  • Cosmetic preferences or subjective dissatisfaction not related to product performance
  • Claims where the customer cannot demonstrate that APi's instructions were followed precisely

Claims Process

  1. Initial Contact: Return product to your authorized APi dealer first. If dealer is unable to assist, contact APi at info@apiwater.com or 1-800-407-9964 with your case details.
  2. Documentation Submission: Upon receiving a case number, you must submit all required documentation within 10 business days. Failure to provide complete documentation will result in automatic denial.
  3. Product Return: If your claim is approved, it may be requested you ship the unused portion of the product with your case number to the address provided by APi within 15 business days. Products not returned will result in claim cancellation.
  4. APi's Decision: APi will review your claim and notify you of approval or denial within 30 business days. APi's decision is final and binding.
  5. Remedy: If approved, APi will provide, at APi's sole discretion, either replacement product of equal value OR a refund of the actual purchase price paid (not including shipping, taxes, or dealer markup). Refunds will be issued via check within 45 days of claim approval.


NO ALGAE PERFORMANCE GUARANTEE FOR E-Z POOL® AND REVIVE!® PRODUCTS

APi guarantees that when E-Z POOL® and Revive!® products are used together according to APi's complete written treatment protocol, your residential swimming pool will remain free of visible algae growth.

Program Eligibility Requirements

To qualify for algae treatment reimbursement, ALL conditions must be met:

  1. Product Purchase: Both E-Z POOL® AND Revive!® must have been purchased from authorized APi sellers within the past 90 days
  2. Residential Pools Only: This guarantee applies exclusively to residential in-ground and above-ground swimming pools. Does NOT apply to spas, hot tubs, commercial pools, natural pools, saltwater pools using chlorine generators, or pools using any competing chemical programs
  3. Complete Protocol Compliance: You must have followed APi's complete written treatment protocol without deviation, including:
  • Initial water balance to APi specifications before starting program
  • Proper dosing based on tested pool volume (not estimated)
  • Required application frequency per APi instructions
  • Proper filtration run times as specified
  • No use of competing products or supplemental algaecides
  1. Maintenance Records Required: You must provide written records documenting: weekly water test results (pH, alkalinity, hardness, phosphates), product application dates and quantities, filter cleaning/backwash schedule, and any other chemicals added to pool

Remedy Limitations

If algae develops despite documented compliance with APi's complete protocol:

  • APi will reimburse the cost of chlorine shock treatment not to exceed $75 per incident or $150 per calendar year per customer
  • Reimbursement is for chlorine shock product cost only - does NOT include labor, service calls, pool draining, acid washing, equipment repair, or any other remediation costs
  • Reimbursement requires receipt from authorized dealers showing chlorine shock purchase specifically for algae treatment
  • Customer must submit claim within 7 days of algae appearance
  • Maximum of two (2) claims per customer per year

Exclusions - No Algae Guarantee Does NOT Apply To:

  • Mustard algae, black algae, or pink slime (these require specialized treatment)
  • Algae resulting from pool winterization or opening procedures
  • Pools that have had algae present within 30 days before starting APi program
  • Discoloration, or staining (even if algae-related)
  • Pools with known phosphate levels above 500 ppb
  • Pools with inadequate circulation or filtration systems

GENERAL TERMS AND CONDITIONS

Limitation of Liability

THIS GUARANTEE IS YOUR SOLE AND EXCLUSIVE REMEDY. APi's total liability under this guarantee or otherwise shall not exceed the purchase price actually paid for the product. APi IS NOT LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES INCLUDING BUT NOT LIMITED TO: pool resurfacing, replastering, liner replacement, equipment damage or replacement, water replacement costs, loss of use, time and inconvenience, lost profits, or any other indirect damages, even if APi has been advised of the possibility of such damages.

No Other Warranties

THIS GUARANTEE, TOGETHER WITH ANY IMPLIED WARRANTIES REQUIRED BY LAW (LIMITED TO THE SHORTEST DURATION PERMITTED BY LAW), CONSTITUTES THE ONLY WARRANTY MADE BY APi. APi EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Proper Use Required

This guarantee applies only when products are used for their intended purpose in accordance with all instructions, warnings, and precautions on the product label and in APi's published literature. APi reserves the right to modify product formulations and instructions at any time.

Fraudulent Claims

Submission of false information, altered documentation, or fraudulent claims will result in immediate denial, forfeiture of all guarantee rights, and potential legal action.

Governing Law

This guarantee is governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes must be resolved in Palm Beach County, Florida.

Modification Rights

APi reserves the right to modify, suspend, or terminate this guarantee at any time without prior notice. The version in effect at the time of your purchase governs your claim.
