This Privacy Policy applies to personal information collected online by Pure Pools, Inc. dba APi (also referred to as “APi Water”, collectively “APi”, “we”, “us”, or “our”) in connection with its U.S.-based website, https://www.apiwater.com, including any microsites or mobile versions of the website (collectively the “Website”), our Social Media Pages, and our SMS/MMS text messaging programs.

This Privacy Policy is intended to assist you in understanding what information we gather about you, how we use that information, and the safeguards we have in place to protect it. By using our Website or participating in our SMS programs, you agree to the terms of this Privacy Policy.

1. How We Collect Information

Information You Provide

We and our third-party service providers collect and store your personal information when you voluntarily provide it, including when you request information, create an account, contact us, or opt in to text message communications. Information we may ask you to provide includes: name, company name, address, email address, phone number (including mobile number), and purchase history.

2. How We Use the Information We Collect

The information we collect helps us personalize your experience, continually improve our Website and services, and communicate with you effectively. Specifically, we use your information to:

  • Send you marketing communications, including promotional emails and, where you have consented, SMS/MMS text messages.

3. SMS / MMS Text Messaging

Program Description

APi may offer SMS and MMS text messaging programs to send you product information, promotional offers, order updates, and other communications relevant to your relationship with APi (“SMS Program”). Message frequency varies based on the program; we will disclose estimated frequency at the time of enrollment.

How to Opt In

You may opt in to our SMS Program by:

  • Completing an online opt-in form on our Website and checking the designated SMS consent box (this box will not be pre-checked);
  • Texting a designated keyword to our short code as indicated at sign-up; or
  • Other methods disclosed at the point of collection.

By opting in, you expressly consent in writing to receive automated recurring marketing and/or informational text messages from APi at the mobile number you provide. Consent to receive text messages is not a condition of purchasing any product or service from APi.

How to Opt Out

You may revoke your consent to receive SMS/MMS messages at any time by:

  • Texting STOP, QUIT, CANCEL, UNSUBSCRIBE, or END to any APi text message you receive;
  • Emailing us at privacy@apiwater.com with your name and mobile number;
  • Calling us at 561-743-0449; or
  • Submitting a request through the Contact Us form on our Website.

Upon receipt of a valid opt-out request, we will send one final text message confirming that you have been unsubscribed. You will not receive further SMS marketing messages after that confirmation. We will process all opt-out requests within 10 business days in accordance with applicable FCC rules. You may opt back in at any time by texting START or re-enrolling through our Website.

Transactional Messages

Even if you opt out of marketing texts, we may still send you transactional messages related to an active order, warranty claim, or service request (e.g., order confirmation, shipping updates) where required or permitted by law. These messages are not marketing messages and are sent to support your transaction.

Third-Party SMS Providers

We use third-party SMS platform providers to deliver text messages on our behalf. Your mobile number and messaging data may be shared with these providers solely to operate the SMS Program. These providers are prohibited from using your information for any other purpose.

4. Your Communication Choices

Email

You may opt out of marketing emails at any time by clicking the “unsubscribe” link in any marketing email. You may still receive non-marketing transactional emails (e.g., order confirmations, customer service responses) even after opting out.

Advertising

For information about opt-out programs for interest-based advertising, visit the DAA Opt-Out (www.aboutads.info/choices) or NAI Opt-Out (optout.networkadvertising.org). Please note that our systems may not recognize “Do Not Track” browser signals.

5. Consumer Privacy Rights

  • Right to Delete: Request deletion of personal information we have collected, subject to certain exceptions.

6. Children’s Privacy

Our Website and SMS programs are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected personal information from a child under 13, we will take steps to delete such information promptly. 7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with our legal obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed for these purposes, we delete or anonymize it. SMS opt-in and opt-out consent records are retained for a minimum of 4 years in accordance with TCPA requirements.

We have implemented security controls reasonably designed to protect your information against unauthorized acquisition and use, and we regularly monitor our systems for possible vulnerabilities. While we implement these security measures, no method of data transmission or storage is 100% secure. In the event of a material data breach affecting your personal information, we will notify affected individuals as required by applicable law.
